La plus grande partie du Sahara Occidental est illégalement occupée depuis 1975. Le Maroc essaie d’intégrer le pays occupé dans sa propre économie, et à travers ce nouveau "EU membership light" quasi membre de l’Union Européenne, l’UE risque de légitimer plus avant ce processus.

Les pourparlers EU-Maroc n’ont pas, à ce jour, statué que le Sahara Occidental occupé serait tenu hors de cette coopération.

"Si l’UE n’exclut pas clairement le Sahara Occidental de l’accord « statut avancé », cela pourrait finir par devenir un soutien à l’ occupation illégale du Maroc sur son voisin », selon Cate Lewis, coordinatrice internationale de Western Sahara Resource Watch (WSRW), les initiateurs de la pétition.

"Si l’UE a perdu ses attaches fondamentales à l’éthique et à la loi internationale, il revient à la société civile internationale de lui monter ses responsabilités » a poursuivi Lewis.

Toutes les principales organisations sahraouies et réseaux travaillant dans le pays occupé ou en exil se sont joints à la campagne nommée « non à un statut avancé pour un pays occupé ». la lettre a été envoyée à Benita Ferrero-Waldner, commissaire de l’UE aux affaires étrangères. 

"En 4 simples semaines depuis que nous avons ouvert la pétition nous avons vu une avalanche d’organisation rejoignant l’appel. Ce soutien mondial massif reflète aussi la réelle préoccupation du peuple sahraoui à propos des intentions de l’UE » a exposé Lewis.

Parmi les signataires, se trouvent des organisations internationales renommées comme Solidar, la Fondation Rafto, Unrepresented Nations and Peoples Organisation (UNPO, Organisation des nations et des peuples non-représentés) et War on Want, côte à côte avec des unions de travailleurs comme le COSATU Sud-Africain, les Espagnols CCOO Comisiones Obreras et Unión Sindical Obrera (USO), aussi bien que l’organisation la Fédération mondiale des unions de travailleurs. 

La pétition a aussi reçu le soutien de partis politiques, comme le Parti Libéral Norvégien, le Parti Communiste Sud Africain, l’Alliance des Socialistes australiens, et l’Unión Progreso y Democracia espagnole. La demande d’exclusion du Sahara Occidental de l’accord « statut avancé » du Maroc a aussi été soutenue depuis les institutions européennes, à travers la signature de l’intergroupe du Parlement européen pour le Sahara Occidental.

Plus de 100 résolutions de l’ONU appellent au respect du droit du peuple sahraoui à l’autodétermination. L’ONU considère le Sahara Occidental comme un problème de décolonisation et dénomme le territoire comme occupé et annexé. En outre, les revendications infondées du Maroc sur le territoire ont été rejetées par la Cour Internationale de Justice.

WSRW est un réseau mondial regroupant des organisations de plus de 30 pays dans le monde entier, travaillant à protéger les ressources naturelles du peuple sahraoui contre les intérêts d’affaire marocain et étranger au Sahara Occidental occupé.

Le Statut avancé avec le Maroc ne doit pas inclure le Sahara Occidental

Nous, signataires de cette pétition, demandons que l'Union européenne n'accorde pas le dénommé Statut avancé au Maroc, à moins que le territoire occupé du Sahara Occidental ne soit explicitement exclu de l'accord. 

L'UE et le Maroc sont en train de mener des discussions afin d'approfondir leurs relations par le bais de cet accord. Jusqu’à présent, dans les rapports sur les négociations euro-marocaines, il n’est nullement fait mention de l’exclusion du Sahara Occidental de cet accord. 

Si l'UE décidait d'accorder un Statut avancé au Sahara Occidental, par le biais des négociations menées avec le Maroc en tant que puissance occupante, l'UE donnerait un signal de soutien à la revendication territoriale marocaine infondée. Une telle décision pourrait mettre en danger les effort des Nations unies pour décoloniser le territoire. 

Nous tenons à souligner que le Maroc a toujours été et est encore une puissance occupante au Sahara Occidental, en violation de plus d’une centaine de résolutions des Nations unies qui exigent le droit à l’autodétermination pour le peuple sahraoui. Bon nombre de résolutions mettent en évidence que le Sahara Occidental est un territoire occupé et annexé. De plus, la Cour Internationale de Justice a rejeté les revendications du Maroc sur le Sahara Occidental. Les Nations unies traitent le Sahara Occidental comme un problème de décolonisation. 

Au regard du droit international en vigueur, l'UE et ses Etats membres ont le devoir de ne pas reconnaître l'annexion du Sahara Occidental par le Maroc, et de soutenir la décolonisation du territoire. Cela relève également d’un devoir moral, tant que le peuple sahraoui souffre de l'exile et subit les violations des droits humains par les forces d’occupation dans les territoires occupés du Sahara Occidental. 

L'UE doit montrer clairement que le Sahara Occidental est exclu sans ambiguïté de la zone d’application territoriale de l’accord de Statut avancé, sans en confier la responsabilité au Maroc. 

En incluant une telle clause, l’UE suivrait l’exemple des Etats-Unis qui ont spécifiquement exclu le Sahara Occidental de leur accord de libre échange avec le Maroc. L'UE a par ailleurs fait figurer une clause analogue dans son accord euro-israélien, excluant explicitement les territoires palestiniens occupés. Pourquoi ne fait-elle pas de même pour le Sahara Occidental? Nous prions l'UE de s’en tenir à ce précédent et de soutenir le processus de paix mené par l'ONU en respectant son devoir de non-reconnaissance. 

Nous, signataires de cette pétition, ne nous opposons pas par principe à une coopération renforcée entre l'UE et le Maroc. Néanmoins, nous demandons que l'accord auquel les négociations pour le Statut avancé aboutiront, précise que son application ne s'étend pas au-delà des frontières marocaines internationalement reconnues, notamment 27°40'N.
